Timothy Joseph Mahar, 41, of Eufaula, was arrested June 17 following an alleged hitand-run incident in the Xtreme Resort.

Charges against Mahar include driving a motor vehicle under the influence of alcohol, placing body fluid on a government employee, leaving the scene of an accident involving damage, threatening to perform an act of violence and acts resulting in gross injury.

Associate District Judge Brendon Bridges entered a not guilty plea on behalf of the defendant and set bond at $75,000.

According to arresting officer Michael Harris the suspect ran into the rear of a 2011 Chevy Equinox containing three juveniles at about 7:30 p.m.

The juveniles stated the suspect appeared to be drunk and was belligerent as he left the scene in a green Mini Cooper, according to a Probable Cause Affidavit.

Minutes later Police Chief David Bryning stopped the vehicle near the Pavilion in the cove.

Harris reported that Mahar smelled of alcohol and refused to be tested on the scene.

The officer transported the suspect to the county jail and Mahar spewed a series of obscenities and threats and at one point spat on him.

After Associate District Judge Brendon Bridges issued a blood warrant ordering the suspect be given a blood test, Harris transported Mahar to the McAlester Regional Medical Center.

The string of expletives continued to and from McAlester.
