A warrant has been issued for the arrest of Donte Jordan Smith, 32, of Tulsa following his failure to appear at a hearing on a charge of enabling child abuse last week.
Smith and Rachael Lane, 28, of Eufaula, were charged in February with enabling child abuse and conspiracy in connection with the alleged videotaping of a child vaping that was posted on social media.
Smith was due to appear before Special Judge Brian McLaughlin at 9 a.m. Tuesday, Sept. 16. When he didn’t show up McLaughlin issued the warrant and ordered the forfeiture of Smith’s $60,000 bond.
Meanwhile, Lane, the alleged co-conspirator, has been hit with the additional charge of false reporting of a crime, filed on May 6, following an alleged confrontation with an acquaintance on April 21.
Lane reportedly told police she went to the person involved in the altercation to ask her why she posted the video of her child vaping.
After Lane reported that she had been attacked during the meeting, investigators determined that she allegedly filed a false report.
She is due in court at 9 a.m. on Dec. 9 to answer that charge and also the charges of enabling child abuse and conspiracy.
Lane was initially arrested on Jan. 30 after a video on Facebook allegedly showed a toddler being assisted vaping on a bed with an adult female beside it.
Police reported Lane was the child’s mother and ex-boyfriend Donte Smith the toddler’s father.
It is alleged that Smith used a cellphone to video Lane on a bed with her toddler son assisting him to inhale smoke from a vape pen.
Lane said the video was taken without her permission and then it was used to blackmail her, Smith threatening to share it online.
