Two plead guilty to aiding a toddler to vape

The couple charged with child abuse for assisting their toddler to vape have pled guilty.

Rachael Marie Lane, 28, Eufaula, and Donte Jordan Smith, 32, Tulsa were charged with enabling child abuse and conspiracy in connection with the alleged videotaping of a child vaping that was posted on social media.

Lane entered a guilty plea at a Dec. 9 hearing.

Special Judge Brian McLaughlin sentenced her to 20 years in prison on the abuse charge, but suspended the sentence and fined her $750. On the conspiracy charge, she ws given a 10-year sentence, also suspended, and fined $500.

Smith entered a guilty plea to both counts at a Dec. 16.

McLaughlin handed him similar sentences that Lane received but ordered him to take parenting classes. Lane was initially arrested on Jan. 30 after a video on Facebook allegedly showed a toddler being assisted vaping on a bed with an adult female beside it.

Police reported Lane was the child’s mother and ex-boyfriend Donte Smith the toddler’s father.

It is alleged that Smith used a cellphone to video Lane on a bed with her toddler son assisting him to inhale smoke from a vape pen.

Lane stated in an interview with arresting Officer Josh Cunningham that the pen contained nicotine, but Cunningham said the type of pen used is commonly used with marijuana.
